1. Introduction

Welcome to Vybes.fun ("Platform"), operated by Investdex Software Ltd. These Terms of Service govern your access to and use of our token creation and launch platform on the Solana blockchain. By accessing or using Vybes.fun, you agree to be bound by these Terms.

2. Eligibility & Restricted Jurisdictions

To use Vybes.fun, you must:

• • Be at least 18 years of age
• • Have the legal capacity to enter into these Terms
• • NOT be a resident of, or accessing the Platform from, the United States of America
• • Not be subject to any sanctions or located in a sanctioned jurisdiction
• • Comply with all applicable laws in your jurisdiction regarding cryptocurrency

3. Platform Services

Vybes.fun provides the following services on the Solana blockchain:

• • Token Creation: Create SPL tokens on Solana
• • Token Launch: Launch tokens with bonding curve mechanics
• • Trading: Buy and sell tokens created on the Platform
• • Token Chat: Community messaging for each token
• • Rewards: Points and rewards system for platform activity
• • Wallet Integration: Connect via MetaMask, Phantom, or WalletConnect

4. Fees

The following fees apply to Platform usage:

• • Token Creation: Free
• • Trading Fee: 1% on all buy and sell transactions
• • Network Fees: Standard Solana transaction fees (paid to network)

Fees are subject to change with prior notice. All fees are non-refundable.

5. Wallet & Security

You are solely responsible for maintaining the security of your wallet and private keys. Vybes.fun:

• • Never stores or has access to your private keys
• • Cannot recover lost wallets or reverse transactions
• • Is not responsible for any loss due to compromised wallets
• • Recommends using hardware wallets for significant holdings

6. Token Creator Responsibilities

When creating tokens on Vybes.fun, you agree:

• • You have the right to use any names, logos, or content associated with your token
• • Your token does not impersonate or infringe on existing brands or trademarks
• • You will not create tokens for fraudulent, deceptive, or illegal purposes
• • You are solely responsible for the tokens you create and their outcomes
• • You will comply with all applicable laws regarding token creation and sale

7. Prohibited Activities

You agree not to:

• • Create scam, rug-pull, or fraudulent tokens
• • Impersonate other projects, brands, or individuals
• • Manipulate markets through wash trading or coordinated schemes
• • Post illegal, harmful, or offensive content in token chats
• • Use bots or automated systems to gain unfair advantages
• • Circumvent geographic restrictions or access controls
• • Engage in money laundering or terrorist financing

Violation may result in immediate account suspension and token delisting.

8. Risk Disclaimer

• • Past performance does not guarantee future results
• • Most tokens created on launch platforms lose value
• • Only invest what you can afford to lose completely
• • This is not financial, investment, or legal advice
• • Conduct your own research before any investment

9. No Financial Advice

Nothing on Vybes.fun constitutes financial, investment, legal, or tax advice. We do not recommend or endorse any tokens listed on the Platform. All investment decisions are made at your own risk and discretion. Consult qualified professionals before making investment decisions.

10. Limitation of Liability

To the maximum extent permitted by law, Investdex Software Ltd and its affiliates shall not be liable for:

• • Loss of profits, data, or cryptocurrency
• • Actions of third-party token creators
• • Smart contract bugs or exploits
• • Blockchain network issues or failures
• • Hacks, security breaches, or unauthorized access
• • Regulatory actions or changes in law

Your use of the Platform is at your sole risk. The Platform is provided "as is" without warranties of any kind.

11. Indemnification

You agree to indemnify and hold harmless Investdex Software Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Platform at any time, without notice, for violation of these Terms or for any other reason. Upon termination, you remain responsible for any pending transactions and obligations.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the United Kingdom.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
